John Linzer is active in patent prosecution and patent litigation. As a registered patent attorney, Mr. Linzer’s prosecution experience involves working with inventors and corporate counsel beginning at the earliest stages of the patent process. His litigation experience includes appearances at the trial level in U.S. district courts and in the appellate phase before the U.S. Court of Appeals for the Federal Circuit.
Mr. Linzer’s prosecution work includes obtaining and evaluating technical disclosures, performing patent novelty searches, rendering opinions on issues of claim construction, infringement and validity, and preparing, filing and prosecuting patent applications. Mr. Linzer also conducts examiner interviews and responds to Office Actions with amendments, arguments, and when appropriate, he handles appeals, all with the single-minded goal of obtaining issuance of strong enduring patents for the firm’s clients.
In patent litigation, Mr. Linzer’s experience includes drafting pleadings, e.g., complaints and answers, drafting and responding to discovery requests and motions, preparing for and assisting in depositions, preparing principal and reply briefs on issues of claim construction, validity and infringement and preparing for oral argument before the Federal Circuit. He has the experience and ability to meet even the accelerated pace of actions in the U.S. International Trade Commission (ITC).
Mr. Linzer earned his J.D., cum laude, from Notre Dame Law School, and his B.S. in Mechanical Engineering, cum laude, from the University of Notre Dame.
